Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I am helping a friend with her Citi Finance situation, and have read through the threads here but can't find the information I am looking for.
The situation is this;
She lost her job and as a result couldn't afford the repayments, she contacted them to advise them and asked if the payments could be lowered, they said that they couldn't. SHe paid in cash small amount as and when she could but was now incuring charges because she wasn't paying the full amount. The next thing that happens is she receives a call from a debt collection agency, saying that if full payment is not made by tomorrow then she will be taken to court. She has asked for a payment plan and this has been turned down.
What can she do? I've done a bank claim before so I would assume she can send an SAR putting the account on hold because there is an open query and then this can not be followed through. Is this correct? I'm sorry if I'm repeating a question already asked , but I have limited time to look through the threads during my lunch break. Please help me help her.
Get her to send an SAR to Citi as it was them that slapped all the charges on. More or less same thing happened to me and Citi have paid half the charges back to the DCA. About to start moneyclaim now to get the rest!
They'll probably still chase her. If they are continually phoning her, tell her to remind them of the law regarding harassing telephone calls. That should stop them.
Or tell her to ring them up telling them she has a new contact number and give them the number for the nearest McDonanlds or massage parlour!!
