Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
My girlfriend opened a Natwest account when she was 18 (she is now 23). There was a £10 monthly fee for the account however after a couple of days she decided she didn't want the account so she cancelled it so they sent her a cancellation form and she returned it. She moved away from the area a few days later and got married.
A couple of months back she got a letter from a debt collection agency stating that she owed £689.23 for the account. Some of it was the £10 monthly account fee and the rest was charges.
We explained that the account was never activated (no deposts, withdrawls or direct debits were set up) and she had returned the cancellation form.
The debt collection agency were not interested in this and said we had to pay. We refused and went to the Natwest branch she opened it in to sort this out. They refused to do anything about it and said it wasn't in there hands anymore and we would have to deal with the debt collection agency.
We have been going back and forth ( a new agency was assigned to the case) and we were told that the new agency would contact Natwest and get some details.
They called us tonight and said Natwest had just told them we owed £300 + pounds in monthly charges and we had to pay it. The debt collection agency has now passed us to Natwest and they will take us to coutrt to recover the money !!!!!!!!
How can this be possible. My girlfriend is very worried and in my eyes both the bank and collection agency are demanding money with menaces !!!!!!
Oh yes oh yes oh yes I can. If advantage Gold is cancelled within the first 90 days then all charges have to be refunded including Unarranged Borrowing fees should there be any. Can I ask whether she was actually closing the account? If no then I am afraid it isn;t as simple as my first thoughts. However penalty charges are penalty charges

Yeah she cancelled the account.
She called up the bank and cancelled, they said she had to fill in a form so then sent it her and she returned it. The bank are now saying they never received this which is why they didn't close the account.
