Im just filling my claim against Halifax i've recived my 6 years of statements and am going to put them in the spread sheet. Halifax owe me £2770 in charges but the statements only say charges as notified am i ok putting this in the spread sheet or do i need to be more specific on the details? ( most of the charges are unpaid direct debits ). Also do i need to work out interest because every time interest was added my account was back out of overdraft due to my wages being paid in by then. Hope someone can help!
First unless you can find out what the specifically charged you for (on your statements) or letters, just put chargesw as notified, regarding interest, you only charge the 8% interest at county court stage, however in your pelim leter and letter before action you will be attaching a schedle of charges as per the spreadsheet, only include interest at this stage that has arisen soley due to you being charged for going overdrawen SOLEY due to the bank charges.
Hope that helps
Recived letter from the Halifax on 26th Oct offering £756 as a " goodwill gesture" im now going to send away the lba. Is it possible to accept the £756 under the circumstances that i still want the rest if so how do i go about this? Do i include this in the LBA?
The Halifax letter says they are offering this as Full and final settlement can anyone help please??
If you want all of your charges back then don't accept this offer. The extra part of the letter that you sign is a not-very-nice inclusion that basically says, "You can have a bit of your money back, but if we charge you again then you can't claim it back and there's SFA* you can do about it."
Send a reply to reject the offer as Full and final settlement. You will accept the offer only as part payment for the full claim - the proper template is in the templates section.
Received letter back from Halifax saying there sorry i dont want to accept there offer but thats all there going to offer. I am now going to persue court action i have recived a charge since is it possible to tack this on as well even though it was not on the original charge list?
As long as you havent filed a small claim as of yet you can add this charge on and just ensure you send them an updated schedule so they cannot claim ignorance to it's appearance on your schedule at court stage.
Im just about to start court action as its been 2 weeks since the lba and they said what they offered is the final offer. I've completed the spread sheet with the 8% extra which has now boosted the claim to over £3100 which is good news and i've registered with the online claims court but im a bit unsure what to do next and i dont want to mess it up can anyone offer any advice??
As soon as the bank acknowledge the claim then you need to send the bank and the county court at Northampton a copy of the Schedule of Charges.

Once you've done that keep checking the MCOL to check on progress and to get the dates for "deemed served" and "date issued" as these will help you track when the bank is supposed to acknowledge, file a defence, pay-up etc.
