Anyway, after three calls to the bank (Lloyds TSB) and a bit of maths, I found they had actually taken the money. I called them again and explained the situation. Basically, they used my old card details to take the money (I'd presumed somehow they'd managed to obtain my new details but the chap in finance said sometimes they try the old details and it's honoured) but as I've told them during their various 8 calls a day back in July and August that I'm with a debt managementicon company, and I've followed this up with emails and letters on 7th August.

The outcome is that Lloyds have raised a dispute and if they argue it (as far as Lloyds is concerned Payday Express is aware because I've told them verbally, the debt management company has told them and sent them money so they shouldn't have done it) they will be fined and the money will be returned to me, plus accrued charges, by 6pm. If they agree, the money will be in my account by 6pm.

Speak to the bank and kick up a stink about it. Make sure they're aware that PE know of your situation, and the money should be returned.

Of course, you may have already dealt with the situation, in which case I hope it went well! But if not, I hope this experience of mine helps you somewhat.

    Take care!

I got paid today and was alarmed to find that Payday Express have taken over 1200 from my account. They are aware that I am now with a repayment planicon and have acknowledged this in writing but when called today, they basically said they are within their rights to take the money and don't care that I have nothing to live on all month and hung up. I have been in tears all afternoon. My bank have raised a dispute and I am just praying that I will get my money back. Today was to be the start of a clean slate.

Bad times, I've cleared my debt and still receive phone callsicon at my work place weeks afterwards chasing payment, I've sent letters, spoken to customer servicesicon several times including supervisors to be promised that it will be resolved to then get more embarrassing phone calls, Payday Express truly are jokes... how they remain in operation is beyond me, good luck to anyone dealing with them!

Did you have any joy using this letter? I took a payday loanicon with payday express through a broker who has now handed my debt onto a collections agency although it's already been paid... I've sent Payday Express and the broker a letter I personally wrote without a templateicon but it went into great detail about the situation, I sent it recorded delivery and I can see it was signed for 7 days ago now... I'm yet to receive a reply, did you receive a written reply and if so how long did it take to receive?

    Thanks.

Would appreciate a reply to the above question as I'm still having issues with payday express they still haven't replied to my original letter... although no reply has been received I haven't received any more calls directly from payday express at my work place... but I am still getting debt collectionicon letters unfortunately and starting to get a bit worried.

Please be aware that all debt owed to payday express has been cleared, there maybe a duplicate on the system or something but I am not aware of this,

    Thanks.

Did you send a copy of this letter to the DCAicon also?
A few lines telling them that you dispute this debt and have sent proof to the OC should have them sending this back to PDE.

Well after Lloyds paid the payday lender the sum of 251.00, still claiming the had to as visa cleared the payment, as the debt should have been paid. I did inform Lloyds that ME and not my wife took out the payday loanicon yet they still took paid from my wife own account as she did quote a debt card to make a payment. ( cancelled along time ago ) . Also Lloyds now chasing my wife for 496.98 just dont know where to turn now , we have wrote to lloyds who refuse to charge back and cancel fees.

1, Loan was taken out by me & not my wife
2, Lloyds paid debt on a basis / confirmation from visa wrong the wife did not take out the loan
3, Lloyds charging HUGH fees more than the payday lender

Can anyone help with this matter

    cheers

well got a letter today from the TSB the account is now 401.00 over drawn, and they demand repayment in full, we feel the bank are blackmailing now by refusing a charge bank of funds which should have not been paid. The payday debt was in my name and not the wifes but the TSB are not playing ball and just adding fees. Clearly the bank is just as bad as the paypday lender

Well today we have had a letter from SCM Solicitors demanding we repay the debt now 407.00 as Lloyds are charges fees. unless we repay now / 14 days they will start court action. I have asked llloyds for theproof of the debt as they state they were told by visa to pay which wenot see that happening. I have wrote to SCM asking them for the proof of debt in my wifes name.

sending recorded delivery as proof we have replied, lets hope they have proof of debt which we dont think they have fingers crossed

Can you post that letter up minus personal info. I'd be interested in seeing how they word that letter.

If, may, could etc etc. You get the idea.

It's also one of their form letters, signed by nobody. Notice the SCM signatureicon. Theyre just a solicitor for hire.

Lloyds have today stopped the access to the online banking, seems strange as now we do not know how many more charges they are adding. We have wrote via recorded delivery asking for the proof of the debt but so far no replies.

We asked them for proof of debt and again they refused claiming 428.00, now a company called midas credit service claim they are acting on behalf of moorcroft and they claim 428.00 , just going around and non of the companys can provid e proof of debt. Can anyone help to sort out this debt

SO Moorcroft own the debt? Chances are they dont care. They are one of the lowest DCAicon's there are. They will just ignore your request. The OC wont care as they would have already claimed the amount back off their tax/insurance.

If moorcroft have sent another DCAicon out after you, then they either own the debt, or they are breaking the terms of their credit licence by sending out a DCA when they are not allowed to. More than one DCA at a time after a debt is a big no-no

We have not been told by lloyds or moorcroft who owns the debt, just another threat letter from midas stating they are now chasing for moorcroft.
