    Default am i able to claim if..

    apologies if this is in the wrong place but i thought i was a general question..
    Right i have a debt in excess of £500 which is currently with a debt collectionicon agent-the debt relates to a nat west account of which a ridiculusly large %age of the debt is bank charges. Am i still able to claim these charges back from the bank (i am no longer an acct holder either) or can i not do so now because they have passed it to a debt collection agent?the debt/charges accrued within the last 6 yearsicon, i was just confused becos no acct now and becos with debt collection..

    Yes you can claim if the account is closed.

    Not sure where you stand if it is with a collection agency as they have basically "bought" the debt from your bank so paying back your bank won't get the collection agency off your back.

    Claim off the bank and send the collection agency back to the bank saying you are suing the bank and if they persist with you you will sue them too.

    OR let them take you to court and make sure your case states it is mainly illegal bank charges you owe!

    Abbey (Charges on 3 accounts and default on my credit record) - DPA letter sent 30/03/06 - 40 days limit is 9th May - Recieved DPA printouts 05/04/06 with microfiche "fob off" letter. <p>Barclaycard (Charges on 1 account and default on my credit record) - DPA letter sent 03/04/06 - 40 days limit is 13th May - Recieved some statements 08/04/06 along with DPA printout and a microfiche "fob off" letter. Claim for £340 sent 11/04/06

    thanks hun, well ive just spoken with Natwesticon about missing statements so as they spoke to me i assume i can still write direct to them, i can account for £348.00 of the debt being these illegal charges (debt is wth the agency and under arrg of £12 per 4 weeks)so even with the charges refunded (hopefully eventually)i would be left still oweing £126.00 so now im thinking if i just carry on with my £12 every 4 weeks but get a letter off to natwest req these charges back. am assuming they wud either pay me or reduce the debt by that much.. just trying to work out about illlegal interesticon charges now, not quite got my head round that one yet, am thinking i shud keep it simple and just request charges??.. great site this! thanks for your advice. hippy. xxxx
