Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have finally managed to get a copy of my original signed agreement from Egg. I have maintained all along that at no time did I request Payment Protection Insurance but have been continually told that I did. Well guess what there is no mention of PPI anywhere on the agreement I signed. I am 99% sure that under the CCA 1974 they have to list this as it forms part of the terms of the agreement but would be grateful if someone could confirm this to me. This is vitally important as they have been charging me around £100 a month for over six years and will wipe most of the debt that they have defaulted me for out. I know that this will probably end up in court so I want to make sure that I am 100% sure of my case. Thanks all.
Wolfy,
I believe, that the Application Form for your Egg CC, that you originally signed is regarded as the Credit Agreement. If you had requested the PPI or as Egg like to call the insurance CRP? then there would have been a secondary (much smaller) box that you would have had to either tick or sign; meaning that if you ticked or signed the box then you would have agreed to the extra PPI or CRP.
If there is nothing on the Application Form acknowledging that you wished to "take advantage of this extra Insurance", that was supposed to protect your monthly repayments in the case of unemployment, disability or death, then you obviously did not agree to it at that time.
Please be aware that this is simply just my humble opinion, I have not legal expertise.
I have had no end of arguments with them over CRP. I transferred a balance over & they deducted this from me for 4 months before I realised costing £600 when I rang them they said its automatically added on unless you tick the box online to say no. Still cant find the box. Just another eggsample for their fleecing capabilities!
