    Default Barclaycard - rolls over

    I have recently begun the (hopefully not too long) process of reclaiming my charges from a number of banks and building societies.

    I began by issuing a Subject access requesticon under the Data Protection Act to all institutions. I was hoping to receive detailed information regarding the charges but most are only returning copies of statements. So this could take a while to check.

    Barclaycard however responded that I could not have this information as it was not filed but stored on microfiche and that my account had been dormant since May 2004.

    So I phoned them up to inform them that I was in fact entitled to this information, when the lady on the phone asked what I wanted this information for. I replied that I wanted to request a refund of the charges and was told I have to email or write confirming this and then they would calculate the total charges applied to my account and refund the amount to me.

    Unbelievable but how good is that. So I will keep you updated on my dealings with Barclaycard and the other institutions.

    Why not start yourself a new threadicon on each of the relevant institutions forums (or as many as you can be bothered with - sounds like you may have quite a few on the go!).

    Use the thread(s) to keep other claimants informed of your progress or ask for advice/encouragement as needed.

    Wow! Lucky you!
    I have a claim against Barclaycard and it's not been as straightforward as that. They have offered me a partial refund of 104.00 (my claim is for 272.00)
    Just be aware that they sometimes only offer to refund you the difference between what they've charged you (usually 20.00) and the 12.00 that they've just reduced their charges to!

    On the phone the lady did say that they would calculate all the charges applied and refund these in full.

    The best bit was not having to go through years worth of statements to find out exactly how much was owed.

    I beginning to think that now may be a good time to start claiming the refund of these charges as I am sure people have been claiming since the OFT judgement in April and maybe by now these institutions are realising there is no point fighting it. This maybe wishful thinking but I'll let you know how things pan out with all my claims.

    Hang on a minute.

    These people have lied to you for years, unlawfully taken your money AND told you it was YOUR fault, but you trust them to calculate your charges and refund them 100% to you?

    Wow.

    I am aware that I don't have the money yet. I also have spent the time going through the old statements so know exactly how much it should be.

    On the plus side I do have the name, direct phone number and email address of the lady who confirmed to me on the telephone that they would refund my money in full.

    Sorry didn't mean to cause offense. Its a good thing you have all the details off the person you spoke to - often they only give a forename, and then you are up against half a dozen of that name.
