    Default lukeyboyuk v BOS - *****Successful Claim*****

    I have received statements for my mortgageicon account.

    The statements include Unpaid Fees, I am happy that these fees can be claimed back.

    I do have a couple of quesitons:

    I have some 'Default Letter' charges, these have been received on a monthly basis when I have had problems with my account. Based on this they don't seem to be default letters as this would only be issued in the event of a default (3 missed payments).

    I am keen to try to reclaim these fees. They originally were £10 but went up to £25. They obviously represent a fair amount.

    I also have a selection of Unpaid direct debiticon fees which are only set at £10, they obviously are not proportionate to the actual cost, they do however fall below the OFT guidelines of £10. Do we have any thoughts on trying to claim these?

      Every kind of penalty fee you mentioned in your post is claimable. It doesn't matter if they are below the OFT guidelines which are £12 I believe as £10 is still a lot more than it costs them to deal with your misdemeanor. IE The £10 is not just covering their costs but still making a profit for the bank. The OFT said they would not "challenge" any organisation that set their charges below £12 I believe. So go get them.....................

      Hi there,

      Im fed up of being overcharged, sometimes its by £2 and a £58 charge is appiled a one off £28 for the month plus £30 for paying my direct debiticon. Does the fact they paid the DD and then applied a charge make any difference???

      Also how did you calculate your interesticon owed?

      The charges are disproportionate so it shouldn't make a difference.

      I calculated the interesticon using a spreadsheet provided on this site. It is only applicable if you file a claim at court.

      Take a look at the FAQ's on this site before you start, they are very useul and helpful.

      I have read that if you are charging the bank contractual interesticon then you mention in all correspondance, has anyone use the advanced sheet yet I cant understand the right hand column (how does it calculate the interest on penalty charges?) The figures seem to come from no where?

      Some people seem to think that the contractualy interesticon is what the bank deserve as a result, plus it takes about 1,000,000 years to work it out!

      Try posting fresh rather than piggy backing on this one, you may get a better response.

      A quick telephone callicon to Melita Mason reveals that BOSicon are readers of the site! 'We received your letter that you got from the website!'

      I am awaiting an appropriate response as they have not broken down their charges to show they are proportionate.

      There are apparently no external email addresses for anyone in the bank! The email I sent in the firstname.surname@bankofs cotland.com format has not bounced!

      Does anyone have any thoughts about filing the lbaicon immediately following their response to this matter?

      The Prelim letter gives the opportunity to resolve the matter, their response indicates that they are unwilling to do so.....

      send lbaicon out. yes they do read the site so personal attacks really dont help. its the bank on the whole not just the person youre dealing with and you may find they dont agree with the 'overpriced' charges either. youve had your response from the prem letter stage 2 now me thinks..

      wasnt meant in that way and yes i have read your thread.just some do try to blame the person they are dealing with and having spent the last 16 weeks reading thousands of threads these people are still waiting. as i said not menat personally to u just a bit of advise.

      So in order to establish if the email address I sent to was correct or not I sent a quick test message to a random name. (test.message@bankofscotla nd.com)

      Suprisingly, this one bounced. I can only assume from that the email I sent was received as it did not bounce.

      This does please me as I was specifically advised 'We don't have external email addresses.'

      Can anyone have a quick look over my other 2 Q's:

      1 - Claiming on a mortgageicon account.
      2 - Sending a lbaicon following their immediate negative response.

      Susanne, only problem with sending to Tommy is that he is at the Royal Bank, not the Bank OS.

      Still, It might make him feel popular, getting sent letters for other banks (we know how sympathetic he can be but this might be stretching it a wee bitty) lol
