My claim todate has followed the standard pattern, i.e, 2 years statements supplied and the normal microfiche + £3 please excuse. I averaged the charges from the last two years data and calculated interest at 20% per year which I then compounded.They then sent me a cheque which represented the difference between the OFT limit of £12 and their actual charge as a goodwill payment. I cashed this cheque (there were no proviso's stating in full & final settlement etc...) and I wrote back saying thanks for the partial payment, now pay the rest.
Barclaycard then promptly sent me a typed list of charges from June 2001- they did not however send me the further statements. I recalculated charges and interest and sent them a revised schedule and interest calculation which they replied to saying that the partial payment was their Full and final offer.
I phoned them up (Carl Nuttall) prior to submitting my MCOL, but they stil stonewalled.
MCOL entered today for £1658 +Court fees+costs.
Beneficial settled in full yesterday after lba. Same with MBNA several weeks ago.Both very helpful. What is wrong with Barclaycard ?!!

Just a quick question, i noticed you mentioned beneficial, It's just that i am starting a claim against them but have never seen there name mentioned on this site until now.
Could please just note what experiance you had with them or a link to the thread of your claim.
MCOL started on 6.10.06, so the 14 response period would have expired on 25.10. Anyway...BCard finally acknowledged claim on 24.10. I am now anticipating their standard defence. Any comments from any BCard successful claimants would be appreciated.
After following the letter procedures and BC's refusal to pay what they owed, I filed MCOL on 6.10.06. The claim was acknowledged on Day 14, and then Defence entered on Day 29, just outside (inside?) the 28 day period. Looking at the forums this would seem to be standard 'delaying' practice - Am I correct in assuming this ? Any info greatfully received.
Just submitted AQ to local county court and my case has been allocated to Small Claims track with a Court date of 5th of March 2007. I contacted Rebecca Connolly at Barclays Legal to pass on this jolly news and to speed up settlement. I have the impresion that they are going to make me an 'offer' later this week/early nest week. Is it correct that costs cannot be claimed through the small claims track ?
(Total claim todate is £1758 inc. fees but w/o costs).

are you asking about your costs of bringing the claim? If so then yes they have to pay your court costs as well.
