Hi wondering what is the best route to take here?

 

Around 2008/9 I took out a vanquis credit card online which I had being paying every month with no problem

 

they kept putting my limit up every couple of month till eventually it was

- if I can recall £2000 limit.

 

everything was fine until there was a big change in my circumstances and then

 

I couldn't afford the payments .

 

I was very unwell with the change and

couldn't cope with any kind of responsibilities at that time. s

o kinda stuck my head in the sand.

at that point think I owed £1485 roughly to the credit card

but as payments were not being made the interest /late payment fees kept mounting!

 

I now owe £1830

 

.this balance was then passed to 1rst Credit and

initially and they sent me a letter offering me a full and final settlement offer roughly for £900

which would have been Ideal big discount

- but I genuinely didn't have the money to pay therefore ignored the letter.

 

. I have since then moved house and have had constant texts, mobile phone calls

(don't know how the got my number ) from all the above DCA and

 

threats of court action from Bryan carter, Fredrickson although I never answer any calls from unknown numbers

it will most likely be them so they haven't proven my ID yet,

 

it's been about 2 years and 3 months since I last made a payment..

 

now Arrow global have passed it onto DEBT MANAGERS LTD,

 

are they sending letters out weekly,

latest one doorstep agent visit,

to discuss arrangements for payment of the full amount owing

..and that I may be entitled to a discount without prejudice for immediate settlement

 

..do I keep on ignoring these letters what do you guys suggest would be the best step here?

Hi, are 1st Credit out of the picture now?

Carter will start a claim then at the hint

of a defence will drop it.

 

Send debt managers the ''prove it'' letter

from the CAG Library addressed to the compliance manager.

 

Vanquis paperwork id often a bit vague.

es 1rst credit they are well out the picture,

 

I think it's possible Arrow owns the debt now,

and possibly Carter gave up as I've never acknowledged any letters or calls from them.

 

It seems as if they just keep passing on to different Dca's now,

 

as it's Debt managers Ltd based in Edinburgh.

 

I'll have a look in the Library at the prove it letter , thank you again :oops:

That's fine, but being a belt & braces kind of bloke I always

I posted a while ago with regards to Arrow

- an update I took on a vanquis card I got into difficulties.

 

I checked my credit report tonight at last! with experian.

 

Arrow has a default on there dated June 10 2010.

It's strange as vanquis account is saying settled! 5/7/2009

 

Arrow has defaulted me so I'm assuming because they have bought the debt?

 

I never got around to sending them a prove it letter,

was panicking about sending one.

 

I'm wondering is this the best route to go still

as now i'm recieving texts and calls from Scotcall a glasgow company

or is it too late for that now a default is showing on my report -confused

If scotcall are around, then the debt is bad. They do NOT chase valid debts.

 

Regarding your credit report, It is normal for an old default to say settled, and a new one to pop up in the new owners name. The other one is normally removed at the end of the month. If it isnt, then you need to write to the data controller of whoever put it there and tell them to remove it.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Presumably the account was defaulted before Vanquis sold it in July 2009.

 

However the default seems to have been rerecorded by Arrow as June 2010?

 

Do you remember getting a default notice?

 

If so, when did you get it?

 

You could start with a prove it letter.

 

I would definitely send an "in writing only" letter as well.

 

Personally I would sidestep the prove it letter and go for a CCA request

- especially if you opened the Vanquis account before 2007.

Hi Bandit, I don't remember any default notice at all, thats not to say I didn't get one tho,

I was going through a difficult time so genuinely can't remember.

 

I'm now at a new address and remarried and not sure what to do.

 

does the default not mean they will have the cca?

 

so If I send the cca is it to scotcall or arrow themselves?

The dates June 2010 and July 2009, are you sure that the 2010 date in not just the date the record was updated?

Vanquis will have defaulted the account prior to the date of sale which would be July 2009.

 

 

I would send a CCA request to Scotcall as they are chasing you.

Or wait until you receive written request for payment from Scotcall.

Depending on the annoyance factor I would also write to tell them that you want all correspondence strictly in writing. Some DCAs are better than others at this.

 

It may take a couple of phone calls where you tell them that they are in contravention of OFT guidance by calling you and that you will complain. (And then hang up). But they will shut up eventually. But when that peace does descend it is golden.

 

It also puts you closer to the driving seat because they will no longer threaten you with all sorts of consequences that they cannot legally impose.

 

It takes A LOT of the stress out of dealing with them.

Ag acquired the account on 05/06/2009 which is why it is marked settled, so default must be before that date.

Which CRA is this?

so pers I would not be entering into any letter tennis with anyone just yet.

 

the discount will be vanquis ROP [PPI} and their PANALTY charges

[£12 late/over/letter/phonecall/its raining today]

 

if they could have done court they would have rather than selling it on.

 

pers i'd sit on you hands

sorry another question if this account is showing satisfactory and settled with vanquis in June 2009.. im assuming thats when global bought the debt.. is there a possibilty that it becomes SB in June this year?
