    Angry Paypal - Ignoring my Issue!

    Hey everyone,

    A few months ago paypalicon contacted me saying a buyer who i sold a mobile phoneicon too was disputing the sale and had requested a claim back for the funds - due to working away from home i only noticed this a month and a half after they automatically made a decision in the buyers favour debiting my paypal account with the sum required.

    I had been in regular contact with them and told them that a) the buyer hadnt returned the item and b) that the item was as it was stated in the ebay ad so there wasnt anything wrong with it... I explained everything to them and told them i wasnt paying as the item wasnt returned etc - i also asked them to get in touch with the buyer to return the item then i would be happy to pay as i tried to get in touch but had no joy.

    Now a couple of months ago they said details had been passed to a debt collectionicon Agency and that they would be in touch - i told them it was unacceptable and i want the funds refunded. No other correspondance has been received and my Credit file is still in good condition with nothing applied to it regarding paypal.

    Just wondered if there is anything more i should or could do??

    Nathe -

    Write to them (not email - a letter) stating that this amount is "in dispute" and that any action taken will be vigourously defended. Inform them again of the circumstances surrounding the item and that you are more than happy to resolve the issue in court if necessary.

    Thanks for your advice!

    Should i send a letter to them though, as its probably been over two months since last hearing anything (Possibly longer)

    I was thinking they might have written it off and not done anything due to the fact im in the UK and they are in the US (and it was a relatively small amount)

    Absolutely send them a letter. However send your letter to the paypalicon UK offices as our Laws are ineffective in the US.

    Dear Sirs

    I refer you to our dialogue between <date> and <date> concerning payment for EBay Item number <nnnnn>. Please be advised that the matter is now "In Dispute" and therefore you may not pursue any enforcement action in relation to it.

    I require you to immediately refund any monies taken from my paypalicon account in relation to this item or to immediately secure return of the item to me as an unpaid item. Further, I require the full contact details of the buyer of this item as I may report this to the Police in due course as a criminal matter.

    I am happy to pursue the financial matter between us via the courts if necessary however I am mindful of my duty to mitigate and therefore I will outline the circumstances surrounding the matter once more in an attempt to secure your goodwill, and the return of the purchase price of the item.

    On <date> I... <explanation of the ENTIRE scenario, missing NOTHING out>.

    I look forward to hearing from you within the next 14 days. If I do not, or if your reply is unsatisfactory, I will issue you with a letter before actionicon as your final opportunity to settle this matter outside the courtroom. I will also report the matter to the Police as a possible criminal offence in which PayPal appears to have been complicit.

    No - you're thinking of Consumer Credit Agreements. paypalicon is a "Pay immediately after service delivered" kind of service and as such is not regulated under the Consumer Credit Act. You're taking them to court because you believe they have unlawfully taken money from you and refused to allow any right of redress.
