help needed.
i have closed down my bank account with RBS. ive had the threatening phone calls from them. their last call was to offer to combine the overdraft from both accounts, add it onto my rbs loan, and this would cost me £160. 00 per month for 5 years. i told them i needed to think about it. They have since done what they suggested and are waiting for their first payment. Do i pay???????????????
Personally I would sent a note to one of the Moderators, there have been previous threads with similar problems.

Have you signed anything or agreed to taking out a consolidation loan ?
That offer to combine stuff is not for your benefit.
How much is each individual debt you have with them? How far behind with payments on each are you ?
Dont worry - have you got caller display ? Don't answer the phone to them, or if you do say you are not prepared to discuss anything on the telephone with them please put it in writing. And hang up.
Also reqeust under the Data Protection Act a copy of the recording of the telephone conversation you had where they offered the loan to you (that sounds like what it is)
hi there, thanks for your reply.
The phone call from the bank was one of many. They threatened me with court, bailiff and having my name on the ccj's.
I have a personal loan of £5000
a current account which was £1,257.00 overdrawn and a bills account which was £635.03 overdrawn.
They offered to consolidate these overdrafts onto my existing loan, this would stop them taking it further, i was to pay £160 a month. They would send me the paperwork after i had paid 2 installments of £160. Then they would know i was serious about paying it back.
I told them i would need to think about it, as im still paying back the unpaid direct debits as well as continuing with the usual payments each month from my new account.
I recieved a letter from them, to say they had done what they suggested and were awaiting my first payment.
Do i pay the full amount of £160, or the agreed loan payment for the original £500 loan.
I am new to this, and dont know how to do a link, sorry
Sue.
p.s i have sent my first letter to the bank, complete with spreadsheet
This bit concerns me ' They would send me the paperwork after i had paid 2 installments of £160. '
Surely they cannot ask for repayments on a loan before sending you the credit agreement or terms of the new loan. If they have done this without his authority then you have nothing to fear and shouldn't be making those payments.
Continue with your normal payments for the loan, and write to them with a repayment proposal (that you can afford) for each of the overdrafts - you already have a parachute account dont you ?
IF you do want to go ahead with a consolidation loan you need to see the paperwork before making payments to them - write and tell them this - set out what the situation is what was said on the telephone and that you will not agree, or make payments to any loan without seeing the full terms and conditions and credit agreement first.
thank you Karnevil
It has left me with many sleepless nights worrying about what to do.
I didnt think they could do it either, but seems like they can do what they like.
They make threats of courts, and bailiffs when we owe them money and get us into a blind panic. But its a different story when its them that caused the debt in the first place, and what we have to go through to get it back.
i will keep you posted.
yes, i have a new account now
hello
i have recieved my get stuffed reply to my first letter, amazingly 4 days after i sent it. now, do i wait for the 14 days to expire before i send the second letter, or do i send it off now.
Best to wait the full 14 days just in the wild chance they may change their minds - it looks better for the court later if you have given them the full time you said you would.....
hello, im about to send my second letter requesting the return of my charges, looking at the templates you have, the second letter starts with sorry you have failed to respond. The problem i have, is they did respond, with the usual letter of get stuffed. so do i alter the start of the letter.
You need to read the complete sentence.......it states that they have failed to respond in a satisfactory manner. This is correct in your case, as in most, so the template should be fine.
Pam.
If anything I've said helps you then please feel free to tip my scales!
