hi, sent DPR 36 days ago, they cashed the cheque but so far have'nt received statements. i have 3 years worth of statements, but need the 2000-2003 as this was a very profitable time for Halifax using my money, i'm not sure i want to give them another 28 days to pay up, i might just send them the letter before action, then guess the 2000-03 amount in a seperate claim, what do you reccommend :?
Hi , You need to read the FAQ there is a step by step procedure you need to stick to so as not to make mistakes, it is there because it is tried and tested, once you have read it just follow the steps and it will all fall together, read my thread for Data Protection Act non compliance.

hi there, i understand what you're saying i just have a horrid feeling that if i send a non compliance letter it will delay the response and the bank can say they have got rid of my statements for 2000 as they do not have to keep them beyond 6 years. the cheque was cashed on 25/08/06 but no statements, what if they have got lost in post, i just having a paranoid moment, thanks for you're reply morgan054

just got off the phone to Halifax asking where the paid statements are, and was told they have no request on the system (perhaps because i asked for dpa request and it went to trinity halifax) anyway explained that the cheque had been cashed but not about the DPA request. the man was very helpfull and said the statements for 2000-2003 would be with me in 3-5 days, it just shows that the banks have this information at a touch of a button. i'm not saying don't ask for DPA, its just seems that sometimes it is opening up a can of worms that is'nt needed. if you can ask for statements for the six years and pay for them go that way. the statements are easier to read than the DPA transaction statements too!!! i will keep you posted
hi there, think i'm getting somewhere. rang the Halifax this morning, they have no request for statements on their systems, i did'nt tell them that i requested them through DPA, as anyone can play stupid. he told me the statements would be with me in 2-3 days at no charge, this might be because i've already had the cheque cashed. as soon as they arrive i will send the lba. thanks for all your help, i will keep you informed;-)
Whilst this approach can work there's no obligation on their part to get them out within a set timescale or as a complete set covering the full date range requested. At least the DPA puts a legal requirement on them to conform.

yes i know you're right, but their time is nearly up under the 40 days and i've heard nothing. in another thread i voiced my fears that after persuing them with a non compliance order it would take my claim beyond the six year period in which they keep transactions. i know this sounds paranoid but i have reason to believe that my bank set all direct debits, standing orders ect to be taken when the money was running out, thus paying them or not would cost me an extra £100-£200 each month. so to wait this out would be beneficail to them. does this sound mad or what? eh well must be getting tired, thanks for advice, you are right. jo
The six years should count from when you make the first approach.
