Sorted - got the wife on the case - she selected the same as me and it worked - AOS with defend all.

do you have an email for Northampton plse?

 

If you want to send in your defence, send it to [email protected]

 

For the email subject put, Claim number: XXXXXXXXX - All the XXXs should be replaced with your claim number.

 

Give a brief into, stating that you are the defendant in the case above and couldn't gain access to the online portal...etc.. then copy in your defence, clearly separating it from your intro.

 

That's how I did it when I requested to change my defence.

Yes...it does appear that way for whatever reason, but the email address is you click on it is correct. If you copy and paste it, just delete the space.

Letter from Mortimer arrived today dated 14th - with reference to my recent letter (my cpr31.14 request) the documents I require have been requested from our client and will be forwarded once received.

- their client is willing to offer a 40% discount and I've got 14 days in which to accept

- if I comply they will send me a Tomlin order.

 

 

When I asked to make arrangement on a Tomlin order they rejected.

Its your choice alan...agreeing to a settlement and entering into a Tomlin is a quick way to resolve this without any further costs or judgment.If you were to proceed and lost then you may on reflection wished you had accepted.

 

But its your decision.

Is it possible for them to try and proceed without producing the documentation

 

 

I have put them to strict proof to provide?

 

 

I would have thought that if it existed they would want pursue for the full amount.

Not always...there are numerous reasons why they would consider a Consent as the best course of action.

Hi Andy

 

The only communication I have had from the court is a letter (23rd July) to say they acknowledge my defence and a copy has been sent to the claimant's solicitors and they have 28 days in which to proceed or else the claim becomes stayed. They would than have to apply to the court for an order to lift the stay.
