Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have just received a Penalty Charge Notice for allegedly being caught in a bus lane. I suspect I just clipped the bus lane whilst trying to turn left (or my wife did). However, I am norally very carfel whilst driving.
I note that the Council have ommiited a letter of my surname. Should I ask them to amend this. I intend, in any case, to ask for a copies of any photographic images they may hold.
It doesn't make any difference for the purpose of the notice, they are allowed to make typing or spelling errors! what they can't do is get the make, colour and reg of the car wrong!!! Go for the photographic evidence and see what it shows.
I think that all bus lanes have to be set up by some statutory instrument which should list the exceptions when people are allowed into a bus lane. It might be worth a look to see if you can find the one for the bus lane where it is alleged that you or your wife entered.
Who is issuing the ticket? You should receive a certificate indicating that the photographs were taken by an approved device and indicating the circumstances in which the photographs were taken , signed by a constable or person authorised by the chief officer of police for the area in which the offence took place. Only once this is done is any evidence from the approved device admissible in evidence.
Look at s. 20 of the Road Traffic Offenders Act 1988, as amended by the Criminal Justice Act 2003.
This sort of offience has now been decriminalised and us dealt with in the same way as parking. Since there is no criminal offence, there is no requirement for any Police involvement It does not go to Court - the appeal will eventually and up at PATAS
Oh I see. I thought bus lanes were still the responsibility of the Transport OCU of the Metropolitan Police. Funny, as it still appears on our charge/summons system.
In that case, I'd suggest getting hold of the Traffic Regulation Order creating the bus lane and see if there are exemptions for turning left.
