Dear Sir/Madam.
We are writing to request the full refund of all bank charges that you have imposed on me and my wife over the past couple of years.
We have been advised from a strong source that the amount of each charge is in effect illegal.
We are frankly quite shocked that you have operated our account in this way as I had always reposed confidence in your integrity and expertise as our fiduciary.
Your responsibilities
We would draw your attention to the terms of the contract which you agreed to at the time that we opened our account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.
We consider that your repeated representations that your charges are fair and reasonable are deceptive and that they have deceived us into agreeing to pay them.
Your concealment of the true nature of your charges has prevented us from asserting our rights until now.
What we require
We calculate that you have taken £XXXXX plus £XXX which you have charged us in overdraft interest for the sum which you have taken. Total £XXXXX .
We enclose a schedule of the charges which we are claiming with this letter.
I claimed from A&L and included paid item charges and interest - the only thing I didn't include was the overdraft arrangement fees and annual charge for OD.

In your letter's 2nd para, you call their charges 'illegal' - I'm not an expert so I'm not 100% sure of my facts but it is my belief that you can't use this term.
If you don't want to use the template word for word you could try something like:-
"It has come to our attention that your system of charging is unlawful at common law, and under statute and recent consumer regulations."
You also need to tell them you are giving them 14 days in which to reply (or enter into dialogue on the matter!).
As I say, I ain't no expert, just trying to offer some friendly advice to a fellow victim. So don't quote me! But if I've helped in any way, that's cool. (You can always click on the scales and tell the world!).
I'm in agreement. Gotta be careful with what you send as if its wrong they will know you don't know what your doing. The original template is tried and tested and i understand you want to send a 'friendly' first letter but they are not very friendly when they take the unlawfull charges!!
When you get further on in this you will see how unfriendly they are as they don't send us personal letters, they are all the same!!

Oh yes include them, its like lindy123 says its just the overdraft charge which is a service.(not the unauthorised overdraft charge as you can claim for these too!)
Failed direct debit charges, paid item charges and unpaid item charges, all of these can be claimed for. Don't include the 8% interest until you file a court claim though.

When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.
