Technically the could appeal, but unless
the over payment is very large I doubt it
would be in the public interest.

Thanks for confirming that Brig.
It was only a small amount, just took alot of fighting to prove they were wrong - DWP didn't send a rep to the appeal, so I wondered if they might try again. Judge said it was unlikely, but wanted me to be aware.
Let's just hope that my DLA appeal turns out positive too!

They can only appeal to the upper tier tribunal on a point of law. It is very rare that they do this.
My advice is based on my opinion, my experience and my education. I do not profess to be an expert in any given field.
