    Default Bigstuff v Barclays

    Hi all,
    Am new here but have already had the "gesture of goodwillicon" offer. my fees amount to £745 and they have offered me £345. Do i accept that offer and send an lbaicon? Please help as i need to know what to write.:-|

    put a little note at top of your lbaicon accepting it as interim payment but say you will pursue your claim for the full amount! good luck!

    Please Help,
    Just had Barclaysicon letter back saying they not prepared to give me any more than the £345 of the £745 they owe me. They re-iterated the "Full and finalicon settlement" excuse and put in the wonderfully amusing line"If you do not wish to accept our offer in full and final settlement,it would appear we are unable to reach a mutually acceptable resolution". .They also stated,without me mentioning anything to them,about me persuing the claim through small claims court. I guess they already know whats coming to them but I need to know in the meantime what to do and wheren to get the necessary forms from either online or by mail.

    I think that if you need to ask, you need to slow down and read a bit more...

    You need to give them the 14 days from the date on the letter you sent, regardless of the "goodwill" offer. I suggest you use the time to do a lot of reading of the FAQs and have a nose round the Library, as all the links are there. ;-)

    Hi All,

    Just a quick update to let you all know my progress.
    I've just had a letter back from Barclaysicon to say "sorry you're not happy with our offer,but you still aint having all your money back!!!",( Offered £345 of my £745 claim). I'd sent it back saying yes I'll take the 345 but I still want the rest. I'm just about to send them the lbaicon and give them 14 days to reply and have just received my lawpack ready to get on the case!

    Let's see what they have to say before I set the ball rolling

    Hi All,

    I'm needing help as I'm a tad confused about my next step.
    I'm at the stage where I need to send Barclaysicon the lbaicon but upon reading the letter in the library,it mentions about sending the bank "schedule of charges" and that I should have done so already. Maybe I'm being a bit dense but I dont understand what this phrase means and cant find anything in the faq's about it. Does it mean that I have to write to the bank listing and dating every charge they've made to my account so they are aware of every one or what?

    Please help,I'm kind of in a quandry at the moment!!!:-|

    Yes, I think you do need a schedule of charges. In my opinion, the schedule is the foundation of your whole claim. To quote "imported", "You are advised to send a breakdown of your claim to your bank with your request for a refund of charges. You are strongly advised to attached a schedule to your claim with the courts."

    But, don't worry. All "the schedule" means is a list of each bank charge which you have already identified as unlawful, with its date, description ("Paid Referral", "Unpaids out" &c.) and amount. You can write out the list if you feel more comfortable with that method, but most of us seem to prefer to use the spreadsheet (simple) from the templates library.

    You should send a copy of your schedule (without the interesticon colums) with your lbaicon.

    Later you will need to attach a copy of the schedule (now with the interest columns) to each copy of the N1 county courticon claim form if you use the paper version, or send a copy to the defendant (Barclaysicon) and another to the court if you have claimed online.

    Hope that helps.

    Hi All,

    Been away for a while after i sent Barclaysicon my lbaicon. They should have replied by last friday to make the 14 day deadline but surprise,surprise,no response!!!

    I dont get paid until next tuesday so i cant file my MCOL til then but come tuesday,THEY'RE HAVIN IT!!!!!!!!!!!!!!

    I've filled in about half the MCOL already,just the important bits to do but it's sat there ready and waiting

    Wish me luck and I,ll keep in touch

    Hi all,

    WHOOPS is all i can say!!! I think ive made a mistake on my MCOL and submitted it.
    What ive done is; in the "address for sending documents and payments(if different)" section ive put Barclaysicon address. I believe i should have left it blank as it should be my own. Is this right and can i rectify it by phoning the court as the claim is now active and been accepted by the court.
