    Dear Mr Marwick.

    Thank you for your letter received on the 18 th September, concerning the charges applied to your account.

    You have referred to the view of the office of fair trading (OFT) on charges. I am aware that the OFT have stated that credit card companies should charge no more than £12.00 in penalty charges for exceeding an agreed limit or failing to make the minimum payment. Our legal department have advised that this investigation is related to credit card charges only and not bank account charges. THe OFT's inquiry is based on th Unfair Terms in Consumer Contracts Regulations to which you have referred, however these regulations do not apply to business customers. I am therefore not willing to refund the charges levied as they were applied in keeping with our terms and conditionsicon, which you will have agreed to.

    Has anyone received a reply like this.? Do I continue with the lbaicon. ?

    Just about everyone gets this letter in one form or another. just ignore it and carry on with your claim

    Me v BofS: Charges: £13,048.10 #2a/c Statements from 08/01/01 received. Charges:£5,156.39 Information Commissioner's Office informed June 12th who wrote to BoS, June 22nd for non-compliance. #1a/c: passed to BoS Senior Review Team. Discovered 2 further a/cs, and 3 Loan accounts. "Goodwill offer" of £7,424.23 06/07/07. Accepted (partial repayment). 20/07/07 Top-up payments of £2,558.10 & £1,154.00
    £11,136.33 paid back thus far.
    New claim issued: 9/07/2007 for 3rd account: £500+ PRESSING ON!

    marwicks, Just to add i have recently claimed back over £25,000 on my business account from Nat West. So they are telling you porkies i am afraid. These will help you.
