Hi everyone, sent off my Data Protection Act to Halifax with £10 enclosed on the 13/09/06. they cashed the cheque on the 19th. i sent the letter by recorded post. do the 40 days start from the 13th or the 19th. be grateful for any advice or tips. thx

Good start read lots of the threads your in the successful wins threads here.so reads the others and see what everyone has done.read the FAQ's and the leads therein so that you know all the aspects.stick to your timetable not theirs and be patient,accept nothing but the full return of all your monies in full.you'll get alsorts of fob off letters.regards Nigel

thanks for the reply, but do i count sat and sundays in the 40 days since the first dpa letter. sent on the 13/09/06. Halifax cashed the £10 cheque on the 19/09/06.regards Ave

The 40 days start from either the date you know that they received the letter (because you sent it recorded delivery) or from 2 days after you sent it (that's how long the Courts accept). So in your case I would start counting from no later than the 15/09.
The 40 days includes ALL days. Weekends, bank holidays () etc Let's not forget that 40 days is almost 6 weeks. That's 6 weeks to push a few buttons and insert sheets of paper into envelopes.
If you haven't heard anything after 4 weeks then it may be worth giving them a ring.

its 27 days since Halifax cashed my £10 Data Protection Act request, and still nothing through the post. do i wait the 40 days, or is it best to gee them along a bit, if they dont reply what then. i will have to read up on other peoples threads. any help gladly received.

Hi bluecloud, re: those telephone numbers you offered is that Halifax head office, trinity road i think, they have to the 25/10/06 to reply from my original dpa letter. i was thinking of giving them a ring, i receive my statements online,but thats only been just recent, so will i receive all my statements and charges online, or in the post, thx for advice in advance.
the 40 days have now passed and i have still not received any statements in the post, is now the time i have to send the lba, ( you have failed to comply with my Data Protection Act request).that one. any help or advice received gratefully.

Thanks for the advice folks, just typed a letter informing them that they have failed to comply with the DPA act.Will send it recorded delivery in the morning. will keep you updated. fingers crossed.

01422332991 and spoke to a nice young man called Mark Kellett,extremely helpful and polite.I spoke to this gentleman in Leeds chasing my mortgage statements for the last 12 years.I've already won 3 cases.They are so busy at moment and there is so many different departments but hey it might speed things up for you ave007.This i believe is there Data protection act dept so my letter said.Regards Nigel

Hi folks, update so far, Dpa sent 13/09/06. did'nt reply within 40 days, sent them letter failing to comply with Dpa request 24/10/06. they have 7 days. Today 01/11/06, i receive statements 142 pages.Halifax owe me £733. wow. is my next step the P.A.R. if so do i just tell them they owe me £703. I have seen the templates in the libary, but i was wondering what is a schedule of charges?. sorry for being a bit thick, but thats me. any advice welcome thank-you.

Hi Ave, you should send a schedule of charges with both the prelim and lba letter. This schedule will later be relied on in court. http://www.consumeractiongroup.co.uk...eadsheets.html. Use simple excel spreadsheet. You can save it into your documents on your computer.

just finished doing my spreadsheet/schedule, what i found in the libary, its added the interest on. is this the correct thing to send at the moment along with the P.A.R. or do i just ask for my £735 back at the moment. thx

morning folks, today had a letter of Halifax saying a member of the customer relations team will get back to me in no less than 4 weeks time, concerning the unlawful charges applied to my account. could anyone tell me is this just a standard blah blah letter. thx

I had exactly the same letter. As per advice I was given on here I kept to my time frame and sent the lba after they had had their 2 weeks! I'm now waiting a response to my LBA!
