i have recently started the ball rolling for reclaiming my excessive charges. over the past 5 years it amounts to nearly £5,000. which when looking closely, was 2500 in one year!!! i was only earning 800-900 p/m and the charges where 160+ per month. i was suffering from severe epilepsy would have seizures on a daily basis, and found it hard to keep on top of my finances. anyway is time went on they started offering me loans to clear the overdraft. after anouther 6-12 months give me anouther top up, until it reached 15,000 i owed them. this was an over commitement, and soon defaulted until i had to seek debt management advice.
Getting back to my original question, do i have the right to demand my charges back when i owe them money for the loan. i know it's cheeky, but don't know if i'm flogging a dead horse. any advice would be very much appreciated.
Yes you can still claim the charges are unlawful and claim then back!!!! we have another member claiming for the loan he had to take out as well due to the charges and will be worth reading the forums to find out more.
