    Default signed banks agreement...... * WON *

    ulster bank owe me 3000 they have paid me out 2000 and asked me to sign agreement that this is in Full and finalicon acceptance of all claims i have against ulster bank for bank charges which i foolishly signed. will this definetly rule me out of making another small claimicon against the ulster bank?

    closey havnt got letter with me but says that they are willing to offer me the full amount as long as i do not tell a third party about it and also that the offer is not an acceptance of liability on their behalf. is also says that the payment is a Full and finalicon settlement of all claims i have against the ulster bank in respect of bank charges.any advice would be greatly apprecieated.

    If it said in Full and finalicon settlement of all claims against ulster bank then yes you cant claim against them again for any outstanding claims. You can, of course, claim again if they start charging you again.

    If it said in full and final settlement of this claim you can.

    rule: dont signicon stuff - write your own letters for future ref.

    Sorry to disagree, but for any agreement to be binding in English law each party to the agreement must provide what is termed 'consideration'. This simply means something of value in the eyes of the law. With these offers in Full and finalicon settlement your consideration consists of a promise not to sue for the remainder. However, the bank does not provide any consideration because they are only giving back what in law belongs to you. The law does not enforce onesided promises. In order to establish that they have provided consideration they would have to prove that the charges were lawful.... which isn't going to happen.

    So both F & F agreements and confidentiality agreements are not worth the paper they are written on! - Unless made by deed
