hi i am confused, i have sent Alliance & Leicester a copy of my bank charges that they have applied over the last 6 years with a request for repayment of charges letter. The total amount they have taken off me is £8,500.00 including interest. They have sent me a letter stating that the OFT law only applies to credt card charges and therefor are refusing to pay. Should i continue with my claim, and if so, will it still be dealt with in the small claims court as the amount is over £5000.00 ? [i only found this out after i had started claiming]. please give me some advice on what to do next!
You've posted in the wrong section - you need to be in the A&L forum, not the A&L Successes one! DOH!
In the mean time, ignore their comments regarding OFT, it's all hot air designed to put you off the scent.
Only claims under £5000 are dealt with under the small claims banner.
However the amount does not include interest; so what is your figure excluding interest? If it is still more than £5000, you can split the claim into smaller parts - leave off the latest charges to get it down to a manageable amount, then start a second claim when the first is sorted.
