    Default Joe vs. Natwest **SETTLED**

    Hello folks.

    This is my first post on here so I want to thank all those who have contributed to this wonderfully inspiring site.

    Following the standard responses to the prelim. letter and lbaicon, I have yesterday filed a claim via money claim for £906.75 in total (including interesticon and court costs), so I guess it's time to sit back and wait.

    Reading through the various threads though, it seems to me that Natwesticon are drawing things out further and further, and I wondered if anyone who has been through this process with Natwest could give me any advice as to what to read to prepare myself for the next stages after they enter a defenceicon...

    an update:

    today, the very day after I filed my claim, I received a letter from customer relations offering me £350 as a Full and finalicon settlement. (I am claiming for just over £900)

    following the advice on these forums, I will be writing back and accepting it only as partial settlement, but I wondered if anyone could advise me on several things to do with this:

    - do I have to let the court know about this offer?

    - do I then have to amend my claimicon amount?

    - when I write back to customer relations do I let them know I have already filed?

    You only have to let the court know if you have actually received any money.
    Send them something along these lines:

    Dear Sir

    Thank you for your letter dated xx/xx/xx and settlement offer of £ XXX

    I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder

    I have already filed a claim in the small claims court and therefore have incurred further costs.

    I request, once again, that you return to me all charges imposed on this account, together with court costs and s69 8% interesticon now totalling £xxxx

    UPDATE:

    After I politely declined their offer as full settlement, they have now written back saying they are withdrawing their offer.

    I have also now received an acknowledgement of service as of 3rd october - does that mean they have until 30th october to file a defenceicon?

    Can anyone let me know what I should do now?

    Also, the address they gave on the acknowledgement of service wasn't this firm Cobbett's everyone seems to be talking about... It is "Group Litigation, 1 Princes Street, London" and is signed by Kay Majid. Is this normal or are they trying something different?

    morning all. i can't believe my luck!

    just a few days after filing their acknowledgement of service, they have paid up in full, £906.75, saying that it wasn't commercially viable to defend even though I wouldn't win etc etc.

    i think this swift payout may be something to do with the fact that (for some reason) it was passed onto the RBSicon group litigation people instead of cobbetts...

    anyway, i want to thank everyone for the info on this site, and I will be donating as soon as the cheque is cleared.

    can anyone advise me on what to write to the courts now to call off my action?
