Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Howdy.
I've got a manager from Bulldog Broadband calling me at some point this afternoon, so if anyone can give me a word of advice as soon as possible please.
The problem is I missed a couple of bill payments on Bulldog so they obviously switched off my service. It's been off for the whole of September, so today I called them up to pay whatever is outstanding. The woman on the phone told me that I have to pay for September, the full whack, even though they had switched off my broadband and phone line.
I tried arguing with the woman that they couldn't charge me for a service that I didn't have, but she insists they can because it was down to me not paying my bill on time.
So, can they charge me for this, the woman stated it was in the terms and conditions. Is there something I can quote, or something I can use to argue my case?

Are you tied to a fixed term contract with Bulldog? i.e. when you signed up, was it for 12 months?
If so, you have to pay for the agreed contract, whether or not the service was provided, as long as Bulldog are not in breach of that contract. As they disconnected you because you didn't pay, then they are not in breach of the contract, you are. They can therefore charge you for the month you were cut off; in fact they can charge you for the entire contract term even if you cancel it today.
If you're not on a fixed term contract (i.e. there is no "tie in" period) then I'm not sure and you would have to post the contract here for us to be sure.
Thanks Tom.
I signed up a while ago, and they had an opening offer of a 1 month contract (fixed term thing).
So, im not under contract to them anymore, or I am, but I can close it without a problem.
Im not trying to get disconnected, Im just loath to pay for a service that i didn't receive (even though it was my fault).
I've sifted through the terms and conditions on the website, but I didn't notice anything, also i don't know if these were the same terms that were in place when I signed up, if that matters. Bulldog Broadband - Legal
I don't have a copy of my contract, im sure it was just done over the phone and I didn't have to sign anything.

OK I've skimmed through them. As neither you nor Bulldog have given thirty days notice of cancellation, then you are still liable for their costs in providing the service; ESPECIALLY as you were disconnected due to your breach of the contract. The ONLY way you could have got out of this is if, before the second of August, you had issued a Notice of Termination to them. Then you would have had to pay for August but not September.

Good luck on the phone Sleepz, just read these posts and I agree with you entirely. It seems so unfair you have to pay for a service that you have not received. Although from a legal point of view Stone is correct.
Let us know how it goes. Maybe ask them for a goodwill gesture for paying for a service you have not received but I doubt they will give it.
