Hi I am new on here

I live in Scotland

 

yesterday I telephoned the council to ask where my refund of £60 council tax overpayment was that I requested in November 2011.

 

I was informed that it was taken for council tax debt for previous address for year 1996/97.

 

Although my husband was only "Liable" person when debt occured.

 

We moved house in 1997 with the same council and they made all relevant checks which is normal when moving within council properties,

checks came back clear and we were given move.

 

My husband and I divorced 5 year later and by then it was policy to place two names on Council Tax as Liable persons.

 

I asked why they took my overpayment and got no joy....

no letters or anything over the years.

 

No letter telling me where my £60 went.

 

If I had not phoned yesterday I would still be waiting.

 

Im so angry all those years and they take my hard earned money.

Dont know where to go for advice but I am not willing to pay £510.

 

Any advice please.

ctax debts sadly can never be Sb'ed

though one of that age can be treated as a NON priority debt

so £5PCM ok?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Thank you for quick response. I know they will get the money but my main gripe is that they (South Lanarkshire Council) do a check before offering a house move and it came back clear. They admitted this yesterday. They also admitted that at no point did they send any letters regarding a outstanding debt. Ive been paying it all my years and heard nothing until I asked for overpayment to be returned! They say it was a Glitch on their system....now the are talking about interest may be due. So much for my husband being Liable person...wish I could find him. Thanks again.

i've never heard of interest ever being allowed to be charged on ctax arrears
