Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
1. Received a letter ref microfiche blah.
2. Sent a letter back stating their need for compliance with data protection.
3. Received a letter back going into more detail of the microfiche blah quoting:
"These statements are not stored by reference to account number of customer name and are not 'readily accessible' within the meaning of the Data Protection Act. These statements are therefore not retained in a relevant filing system and therefore do not fall within the class of documents to be produced pusant to a Subject access request".
If I pay the £3 charge per statement it will cost me nearly £150!!
Any suggestions would be very much appreciated!!!
I have just been reading some of the past Barclaycard threads..... definitely of interest in our case!!
Firstly, check out page 2 'Moorees2525 v Barclaycard' 23 Sept 10:28. He has had all this sh*t and his thread should help with the next step.
Secondly, on page one, right at the botton so could move at any moment, 'Barclaycard microfiche gumph' 23 Sept 16:28. One of the threads is basically stating that Barclaycard are quite within their rights!!
I think I will still continue with this though.... without paying £3 per statement!
Just been looking around too to see what I could find found reference under Abbey - the microfiche argument where alonfromderby has posted this letter so going to give that a try
Yea, thats the second letter I sent, and the reply from that is the one I received today. I really think they will be hard work. I'm going to send another letter copied from someone elses thread. Once done I will put the details on this thread for your reference.
