    Default HoneybadvsHalifax

    Dear All,

    I sent off my prelim letter (dated 13th September) to the Halifaxicon and i received a reply on 22nd September.

    This letter was their bog standard reply stating that they are sorry that i am not happy with the service and that they will be passing my details onto their personal complaints dept to be dealt with - This letter was expected!!

    Am i now within my rights to send off my lbaicon as they have not responded in a positive manner and they have simply replied using their standard letter and leaflet which the prelim letter specifically stated that this was not what i expected as a response.

    Hi Dan

    I know it is frustrating but, my own feeling is that you still have to allow the 14 days because they have told you they are dealing with it. Just stick to the timetable you have already given them. If they had given you a flat "no" as their final response that would be different. We all know that the chance that they will turn up in court is as remote as the chance that I will be crowned queen but, still you have to show you have given them adequate opportunity to respond positively.

    Just my own opinion mind...

    Many thanks for the advice.

    The 14-day deadline expires this friday (29/09). If i have not had any further correspondance from them by this date, can i then go ahead and send my lbaicon?

    MCOL - stands for Money Claim On-line. It is the alternative to taking an N1 form into court. It effectively allows you to make your claim and keep up to date with it via the internet.

    Sarahpp,

    Thought that i should give an update on my situation.

    I have since received a 2nd letter from the Halifaxicon offering me a Full and finalicon settlement of £1,444 re 6 months bank charges (as a gesture of goodwillicon!!!!).

    Bearing in mind i am owed £6,600 i don't think that this is justified!! I know that i can do 1 of 2 things now:

    1) Write back and accept their offer in PARTIAL SETTLEMENT and follow up the remaining balance in lbaicon

    2) Write back a refusal of offer letter and then go ahead with LBA.

    Would really appreciate your thoughts/feedback as i am getting to a crucial stage and do not want to make any mistakes!!!!!
