    Default Help Required with Offer Received

    Hi All,

    I started my money claim vs First Direct for £1800 two weeks ago and today I have received an offer from DG solicitors for about 50% of what I am claiming.


    As I have already issued the claim through money claim which has been acknowledged, I am not sure which template to use. Do I accept their offer and state that I will pursue them for the balance or do I reject the offer completly and state and I will only accept the full amount.

    The general advice seems to be to accept this as a partial refund and state that you will be pursuing your claim for the remainder.

    You could send them this:

    Dear Sir

    Thank you for your letter dated xx/xx/xx and settlement offer of £ XXX

    I have already filed a claim No. XXXX in the small claims court and therefore have incurred further costs

    I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder.

    I request, once again, that you return to me all charges imposed on this account, together with court costs and s69 8% interesticon now totalling £xxxx

    I will be willing to withdraw my claim upon receipt of full unconditional settlement of my claim.
