    Default Halifax pays out

    I helped my son pursue the Halifaxicon for two returned direct debits @ £39, and an unauthorised overdrafticon fee £28.

    After sending an initial letter pointing out the illegality of the charges and the number of people currently pursuing them through the courts, he recieved:

    Within the 10 day limit he set, a letter giving a complaint reference, and a phone number to chase things up (which turned out to be wrong!!)

    Two weeks later a letter (which I've seen on here before) explaining at length how justified they were in making the charges, but they were prepared to refund them in this case. Full marks to them, they'd spotted a charge I'd missed, so offered him £145 when we only asked for £106! He also had to sign to say he would look after his account in future, and they could make further charges oif they want, but this is no big deal, as we're wanting to move the account anyway to one with an agreed overdraft, which should remove the problem of temporarily dipping into the red.

    I'll send the documents in when I can get them scanned, but thanks for your excellent site, and good luck to anyone still chasing. The lady he spoke to on the phone confirmed that they did have a lot of cases to deal with at the moment, so I perhaps they're realising it's less hassle to pay out early!

    Are you saying that it was a condition of the payment that he accepted the charging structure and therefore waived his right to any future claim?

    I don't think it does - they can't enforce an agreement which breaks the law, as they are finding out when the courts chuck out the 'but it's in our terms and conditionsicon' arguement.

    As I said, he'll probably be closing the account soon anyway, but I'd be happy to argue the toss with them in court.

    The way things are moving, they will surely, along with other banks, reduce these charges dramatically, and find another way of getting money out of their customers.
