Sent off my Preliminary letter to Barclaycard on 18th Sept and received this reply today:-
.... As a goodwill gesture and without any admission of liability, i am prepared to credit your account with the difference between the charges that you have incurred and the 12.00 fee recommended by the OFT. This would amount to 84.00 (i am claiming 213.19) ........
I take it i use the 'rejection of settlement' letter in the templates to say thanks but no thanks.
At least this gives me a huge boost, knowing i'm at last getting somewhere.

Yes, send a thanks but no thanks letter. In a few days you'll probably get a cheque for their offer plus a letter saying they're sorry you won't accept the offer as full/final (or words to that effect). Just press on with the claim (less any payment received) after that point.

Had letter from Barclaycard saying they wont budge from the £84 offer, so i guess its onto the Small Claims Court in Scotland. This will be my first time doing this and its a bit scary but i'm determined to give it a go. Collected info from the court a few weeks ago so have info to hand, but if anyone from scotland (especially Aberdeen) is starting this too, it would be nice to hear from you and swop info.

Taking Barclaycard through small claims court in scotland. Will be filling out the forms tonight and keep you all posted on what happens.

Have filled in Forms 1 & 1b for Barclaycard and Marbles and will be taking them both into sheriff court tomorrow to start proceedings. Am hoping it wont get too complicated. And the fee is still £39 i phoned and checked. Will also be asking the defendents to pay by cheque to myself as my accounts are now supposed to be 'closed', as i paid on a settlement figure and i dont want them crediting an account i no longer use.

Will be taking my papers to the Sheriff Court in Aberdeen today to serve on Barclaycard as they wont budge from their offer of £84 and they owe me £213. Waiting with baited breath as to what happens as this is the first time i have served papers in court.

Summons served on Barclaycard on 5th October for 254.53. Return day is 16th November. Just a waiting game now.

They still said my claim lacked merit and would fail, but we all know why they paid out...... now all i have to do is wait for the cheque to arrive.

Thanks for your congrats and i wish you luck in your claims. I still have a 3 in court 2 x RBOS and 1 x Amex. Just waiting to see what happens there. Hopefully they will pay out before the return date !!!
