    Hi Christina

Are the statements that are missing from before may 2004? Barclaycard in their infinite wisdom have stored all statements from before this date on microfiche and claim that this is not a Relevant Filing System under the date protection act and so therefore dont have to supply them. If this is the case you'll have to end up making an estimate of what they have taken. Gumph on the microfiche argument is here http://www.consumeractiongroup.co.uk...che-gumph.html

I doubt they'll ever arrive. I'd give them the 40 days then report them to the OFT. If you gunna estimate the amount make sure you dont underestimate, if anything overestimate and if they wanna dispute the amount there gunna have to cough up the statements

The way people are going about this seems to vary from case to case so you can either spend the next few weeks trying to get your back statements (and as far as I know this is very unlikely to happen) or proceed with an estimate. Note you should still put a complaint into the OFT - think this is the form Data Protection Complaints – Information Commissioner’s Office (ICO)

The main purpose of the estimate is not to say 'this is what you owe me', rather its to say 'prove me wrong and give me the actual figures'.
They are not likely to give you more than your due so hopefully it will make them reveal the actual charges.

The general consensus seems to be to work out your average monthyl charge from the statements they have provided (500/24=20.8) and enter this average charge for each month into the spreadsheet (say the 10th of each month) in order to calculate the interesticon. This is OK so long your frequency of being charged has been fairly constant over the last 6 yearsicon, in my case for instance I know I was incurring lots more charges 4/5 years ago than I do now so will have to add more onto my total that an average would indicate. When you send your preliminary letter for payment explain that this is an estimate and state your reasons why
Think as long as you can explain logically where your figures have come from you shouldnt have a problem

    Response to settlement offer.

    Dear
    [named sender or Sirs]

Thank you for your letter dated
    xx/xx/xx
I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, totalling £xxxx

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a county courticon claim if necessary.

My letter before actionicon sent previously indicates that you have until
xx/xx/xx to respond before Court action commences. You are reminded that there will be no extension to this timescale.

I trust this clarifies my position.

    Yours faithfully

    Hope it helps!!

    Simon.
