Received a Stack of Statements! But no charge summary
Hi All! First post - thanks you for such great information on this site.
I followed the data protection procedure sending the letter to HSBC
They have responded quickly with over 500 sheets of statements for 2 accounts.
They have told me that they do not keep records of the total amounts charged to me over a 6 year period - is this correct, or should they be able to offer a figure?
I am not looking forward to going through all these statements to find the charges!
Re: Received a Stack of Statements! But no charge summary
Hi Lordgaz welcome to the forum.
You could ask them if they do have statements pre the 6 years.
If they have them then under your SAR they are obliged to send them.
Meantime take some time to read your next steps and get a charges schedule done for the info you have.
500 should keep you going for a bit ...phew !!

Re: Received a Stack of Statements! But no charge summary
Hi Martin,
Thank you very much for your response -
I am a little confused about the pre-6 years part of your reply -
Am I able to claim for charges that were levied longer than six years ago?
My request was onlt for the last six yrs.
Or I you saying they are obliged to tell me at this stage the total amount of charges that have been applied to my account for the last 6 years
Re: Received a Stack of Statements! But no charge summary
The 6 year limitation ruling was thought to restrict claims from going beyond the 6 years.
However the banks have been known to pay out for periods before the 6 years.
It is still a grey area and one that has not been done on anywhere near the levels as post 6 claims.
In the first instance you would need to know the figures.
What I was saying is that you would need to ask your bank if indeed there are figures there.
I can tell you its not something they shout from the rooftops about.
Some claimants are trying for the further period after winning claims, but as I say its not something at the moment (that I am aware of ) where there are clear guidelines for you to follow.
Its simply your call as to whether you feel you want to have a go.
You can read more about this here on the site under limitations.
hope that is a little clearer for you.

Re: Received a Stack of Statements! But no charge summary
I think most of my charges came between 1997 and 2000 as I had just moved to London, and I was completely stung by HSBC - I may give it a go.
Do I need to resend the Data Protection letter with £10 again for these earlier dates?
Thank you for your patience in answering my questions.
Re: Received a Stack of Statements! But no charge summary
One payment should cover them all, however as they are assuming you are claiming from the 6 then they have only sent these.
You can send them another letter to force compliance stating that they have not completerly complied with your request, but there is a fence they could hide behind in the Data protection act that states they are not obliged to handle requests that are not specific in their requests. Its a case of looking to see what your original SAR requested specifically.
However you would need to be certain that they do indeed hold this information.
I am aware that Natwest and RBS hold records for longer, but it is archived and takes about 2 weeks to search out.
They are not particularly happy to do it but it is there.
You may get the answer to this question by posting it on the HSBC section,or maybe better still on the Bankworkers threads.
