Just a quick question before I prepare my court case. To update you on my case, I have followed all the instructions to the letter so far & have got the standard response from Abbey....blah blah.. we do not think our charges are unlawful, you should have complained at the time (Did lots of times!!:-| ) etc etc! So off to court we go, they owe us in excess of £5000! (Did eventually get my statements after 3 months!) :o
I wanted to check though, our account was not orginally opened with Abbey, it was a National & Provincial Building Society account that was taken over by Abbey, we had no choice, but we didnt sign any agreements when it was transfered. So Abbey have no arguments re us signing that we agree to their terms & conditions, do I include this in my Court complaint?
Im not sure when they transferred your account were you invited to accept their terms in any way?
ALthough im no expert it would seem that if they did, even if you never signed you have implicityl accepted their t&C.
However, irresepctive of whether their T&C were accepted if they contain clauses which are unfair and allows them to penalise you its irrelevant i believe.

Thanks for replying, the account was transfered many years ago..at least 10 proabably more! Def didnt sign anything but I guess it could be assumed I accepted anyway. As you say its probably irrelevant but I just wanted to check
