Hi - thought I'd better start my thread for London Scottish. Haven't seen many for this company - but after looking through my statements etc. (I keep everything for ages!) and following normal procedures etc. I have issued a claim against them. Deemed served 23rd August - they have until 6th Sept to reply.
today i have recieved a letter from london scottish stating that i agreed to ts and cs, and that they will not refund any money nor will they remove the default.
therefore i shall now file a claim near to pay day (end of month).
will keep posted.
Maxwjz - London Scottish have until today (6th) to acknowledge the claim - hopefully there will be something in the post when I get home today - have not heard a peep out of them since submitting the claim. Will keep you posted.

No - nothing in the post - will give it another couple of days - my claim with Abbey was to be acknowledge by the 4th - court sent a letter saying that they had acknowledged on the 4th!! If I haven't heard by Friday I'm going to ring the court.
My claim with LS cost me £80.00 - I think when you log onto the website there is a page that lists the costs there. Good Luck and keep posting

Have rang the court today - London Scottish have not acknowledged so was advised to send in the Request for Judgement. I don't know if I feel good about this or not - knowing as I do that they will probably plead ignorance etc. etc.
However, I'm filling in my form, asking for immediate payment and we will see.
I asked the court manager if I should contact LS - she said no - they haven't replied so I am entitled to claim my money!!
We will wait and see.

OK - received Judgement for Claimant through this morning from the court. Will wait next week to see if London Scottish send through their cheque - I'm not calling it a victory yet until I have their cheque in my hand!

Some advice would be welcome - have received judgement from court - but have heard nothing from London Scottish. What is the best way forward - telephone London Scottish direct? Do I have to allow them so many weeks or days to contact or send monies? thanks - Jackie

OK - have just spoke to London Scottish - after holding for 15 minutes as the person answering the phone didn't have a clue what I was talking about - another gentleman rang me back. Asked that an office manager could perhaps ring me tomorrow to discuss progress on the complaint. I said "with all due respect - this is no longer a claim and I had received judgement - therefore I would like to know when the monies will be sent". He asked which address I sent the info. to (including the court claim) and I replied to the corresponding address on all of my letters. This, however, does not seem to be their head office.
Does this matter?

Hi - I've posted a thread on this in "Other institutions" but seem to be the only one so far that has issued a claim against this company.
I have received default judgement against them. They failed to acknowledge and defend. Judgement was issued on 14th September.
I was quite undecided what to do - court said that it was up to me as to my next steps. Tried to ring London Scottish yesterday and was told that someone would ring me today (21st) to discuss progress of claim! Respectfully told them that the claim was complete and I had received judgement. No-one rang, so I rang back today, was told by the call centre that they are not allowed to discuss this with me over the phone as it is now being dealt with by their solicitors. I have said that unless I receive correspondence by Saturday, I will be applying for the warrant of execution.
Can anyone advise - have I done the right thing - should I just apply for the warrant anyway - they have had over a week to write to me. I don't really want for them to apply for the set aside and delay this any further.
Does the warrant, if issued now, prevent them from applying for the set aside or can they do that anyway. I'm tempted just to fill in the form and post it tomorrow anyway. Total monies now £801.47 (without warrant fee)
Any advice would be much appreciated - I've read through Nightstar v Barclays and feel that I have already given them too much time (?)

*Bump* anyone - please - I'm really annoyed that these people still think that they can "progress" my complaint when I've received judgement. I think that I'm going to send in the warrant today anyway but some advice on what they can do would be most appreciated.

Best practice after a judgment by default is not to contact the bank, but go for enforcement after a few days. If you contact them it alerts them that they still have time to set aside. Go for enforcement asap.
Many thanks zootscoot - posted warrant recorded delivery yesterday. Hopefully that will work although I'm not holding my breath until I receive payment. Read through Dashngail's posting from you and made my decision from that. Once again, many thanks.

Thank you Les - although having looked at the cheque the figures say £860.47, the words says eight hundred and sixty seven pounds and forty seven pence. They can't even write cheques out properly!! Will take the letter into the bank tomorrow with cheque so that they can verify the amount. Hopefully this will be OK.
