    Default Private parking ticket - N1 Claim Form issued

    Long story short, I got a private parking ticketicon issued against me while parking in St Albans in January. Since the amount was extortionate for stopping for 5mins while dropping a DVD off at Blockbusters I decided to ignore it, I thought they couldn't chase it up anyway. Seems they got my details from the DVLA and have now got a debt collection agency to chase it up through the county courticon. They've sent me a threatening letter giving me 10 days to respond with a Claim Form (N1) attached.

    What are my rights to fight this?

    Seems they got my details from the DVLA
    DVLA totally ignoring the Data Protection Act again? I'd write a letter of complaint. This is what their website says as to their data processing:

    Information held on the DVLA vehicle record is obtained and used for the purpose of registering and licensing vehicles, related law enforcement, road safety and assistance to the police in the prevention of crime.
    So what are they doing releasing information to companies chasing for private debts without consent?

    The N1 has obviously been attached to the letter to frighten you into paying. Respond to them by asking under what legal authority are they seeking this payment - it can only be in contract law if it was a private car park in which case they have to prove that you were aware of the terms and conditionsicon of parking there.

    They also have to prove you were party to the contract, i.e. you were driving. Say you have no idea who was driving... you'd love to help if you could, but it was just so long ago...

    Useful addition to the thread, thanks...

    As you bring up the subject though, I ignored the N1 form as they clearly didn't have a leg to stand on. Guess what? I heard nothing back and I've not paid the ticket.

    Looks like I did have some rights after all... ;-)

    Just wandering fthe op has only ever had 5 posts and the person reply has had 5 posts. Could it be a purpose ploy to activate this thread ?

    I hate bailiffs. Let me know if you have had a problem with them. I am sure i could upset them.
