I printed off the Data Release form and sent it to The Royal Bank of Scotland on the 8th August. After 2 weeks I received a call to ask me if I had received my statements yet, so I told them that no, I hadn't. I was then told they would be with me very shortly, however still nothing has arrived.
They had 40 days in which to supply me with what I had asked (and paid £10) for, so where do I take this now?
I recently had to send a letter to Capital One, low and behold 2 days later they arrived!!! Just write something along the lines of..
I refer to your letter dated (or telephone conversation) ****** regarding the copies of statements which I have requested from *****. Regrettably you have failed to comply with my Data Protection Act Subject access request *******.
If you do not comply within the next 7 days I shall be making a formal complaint to the Information Comissioner and taking further appropriate action if needed.
Thanks for that, I've found a template along similar lines, so I'll fire that off to them. Seems odd that they went past the 40 days despite contacting me...
I gave them a call to see what was happening and if I actually needed to send the reminder letter. Apparently my statements were simply "lost", and this "happens regularly". How convenient.
I was told it usually takes up to 8 weeks to supply what I had asked for, however after reminding her that the law states they have 40 days to comply, and not "as long as it usually takes", I was promised them within another 7-10 days. I won't hold my breath...

I have been postingand asking questions on the forum for several weeks. But no one has so far has responded.
I sent a DPA letter to RBS more than 40 days ago. They have sent me after 42 days a 'Subject access request Application Form' Should I fill this form or what's my next course of action.
By the way I do respond to other members queries but please note I am not an expert.
Hi I sent my DPA letter over 40 days ago, I also sent another letter giving them 7 days this has now expired they have cashed my cheque on receipt or the 1st request what do I do now?
