Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I sent off the S.A.R - (Subject access request) letter together with the £10 fee and have received the following from GE Money:
''We have not been able to locate any statements. However, i have enclosed a list of all transactions for the last 2 years''.
I thought that by law records should be kept for a minimum of 6 years?
What do i do now? I'd be really grateful if anyone out there has had a similar situation and can advise me what to do next?
Re: They cannot locate any statements - what now?!
They are not obliged to provide you with statements, if you read the letter you sent you were actually asking for a list of transactions, which you have received.
Did you request this for the last two years, or did you request it for a longer period?
Opinions given herein are made informally by myself as a lay-person in good faith based on personal experience. For legal advice you must always consult a registered and insured lawyer.

Re: They cannot locate any statements - what now?!
They sent me details on one account but then said on the other account they were unable to locate any statements! They have sent me a list of transactions for the last 2 yeas but I did actually ask for the last 6 years.
They say futher on in their letter, and i quote:
I fully appreciate this does not meet with your requirements and apologise for any inconvenience this may cause. This is certainly not our intention and i am sorry i am unable to provide the information you have requested on this occassion. However, if you have any correspondence relating to disproportionate penalties on your account, please provide us with a copy of these details at your earliest convenience, which will enable us to look into reimbursing the charges - unquote.
Surely they must have records? I don't believe that it should be down to me to give them the information! I was asking them for the information and i paid to get that information! I would be really grateful on where i go from here.
Re: They cannot locate any statements - what now?!
If they say they do not have the information you have requested then you need to give them 40 days before ( send them reminder of this) making a complaint to the Info Comm, sounds like a stalling tactic.

Forget the Information Commisioners Office!
If they don't provide the required information after the 12 working days + 30 days the sue 'em. Issue an N1 claim from your friendly local county court!

I will not make any deals with you. I will not be pushed, filed, stamped, indexed, briefed, debriefed or numbered. My life is my own. Number 6

Erm...thats for a cca request, think we're talking about a DPA SAR when it's 40 days. You are then advise to send the 7 day lba and then apply for a court order!
