Hello,

 

I haven't visited the forums for a while but hope someone can help with the following situation...

 

At the start of June I received a letter from my local authority (east ayrshire) stating that as I hadn't made any payments towards this years account they were adding 10% and demanding full payment immediately. This was because of an oversight - I thought my wife was paying it and she thought I had been paying it - and I immediately contacted them via e-mail to acknowledge their letter and make a proposal for repayment of the arrears over 2 months, and then continue making the normal instalments thereafter. They agreed to this - in writing (via e-mail) - although they said if I didn't comply with the agreement the account would be passed to a Sheriff Officer for recovery.

 

To date I have made the agreed payments and have receipts to support this but this morning - 3 weeks after they accepted my proposal - I received a letter from the sheriff officer demanding full payment!

 

To say I'm upset is an understatement as they have in my opinion reneged on the agreement.

 

So th question is, what now? Of course I'm going to e-mail them all the original correspondence and demand answers but can they legally do this?

 

Hope someone can offer some hints!
