I am just starting out with my claim against citicards, I am currebtly paying off the debt eith a collection agency. What i really want to know is how to work out the total amount to claim for the unlawful charges plus intrest ... my maths aint that good any more any threads out there that will help ??? thanks
You should add all the charges up from your statements as presumably you have them ?
If you have not then read the faqs as you will need to start from scratch and it is essential that you are informed of the process.
Although you ARE paying the DCA it is still Citi you should claim from.
If they defaulted you as a result of penalty charges you need to send Citi a request under s10 of the data protection act to tell them they must cease from further processing any of your data to third parties.
The letter for this is in the banks temp folder.
If you have ongoing repayment arrangements with the DCA you should make it clear to them that you have now become aware that you were the victim of unlawful penalty charges by Citi and want them to suspend any further payment recovery as the account is being disputed.They are legally obliged to comply.Please note that the site in no way advocates debt avoidance where there is clear cases of the debts being self appointed through deliberate means.
However if these debts arose fom wholly or part penalty charges then you have a case for recourse.
