Hi, I hope someone can give some advice, basically we rented a shop from a private landlord, paid the deposit etc and have been paying the business rates direct to the landlord.

 

However, we have recently received this years rates bill from the council, we had to contact the council as we wanted to claim small business relief and they have said they have no record of any rates being paid from the landlord and no rates were due for the previous year. The council are no help, they just say it is a matter between us and the landlord..

 

So my question, as i have not been able to talk to the landlord yet, we wont see them till rent & rates are due, it sounds as though they have been thieving from us (as i say we wont have their side of things for a couple of weeks), can we demand to find out where the money has gone? can we take the missing money off the rent due?

 

If they have been nicking of us, and when we bring it to their attention they are obviously going to get the arse, what can they do? can they let themselves in when we are not there and help themselves to stock etc?

 

Sorry, just panicking as we are trying our hardest to get the shop working and fear we might lose everything again!!!

How did you pay the landlord ?

Have you any receipts ? if not how did you enter these payments in your accounts ?

Better to ask your landlord first and see what he has to say.

For unpaid commercial rent,a landlord or owner can instruct bailiffs to act without any Court Warrants,so yes there is potential for breaking into your business and removing stock and content.

Hi thanks for the quick response, we pay them cash every month and have them sign a document listing all the money we pay them, eg:

Date: xx/xx/xxxx Description: Rent etc, Amount: £xx.xx, signed: by them

 

It is just a word document we have printed out so nothing fancy

All you can do is ask.

Maybe would be an idea to get something in writing from the Council confirming that no rates were payable.

In any case,it looks like they were unaware of your occupancy.

In most cases,a landlord will inform revenues section when he rents a place out-this is a formality and also covers him/her.

Same thing happened to me. My landlord was a massive insurance company and they hadnt paid the rates for months. The council sued me, twice. Eventually, I deducted the amount from the rent and had the tenancy agreement changed so that I paid a lower rent and paid the rates myself. It is the occupier that is liable, and the council wont care what arrangements you have made with your landlord.
