    Default Barclaycard problems

    Barclaycard are one of the companies i want to tackle regarding reclaiming (alot) of charges.

    However, will it be a problem that i am in such severe financial hardship, as a single mother with health problems, that i am currently trying to get Barclaycard agree to a payment plan whereby i only pay £1.00 per month, as reccommnded by Citizens Advice Bureau ( i sent letters with my financial statement, etc). Barclaycard are, incidently, the ONLY company out of all the credit companies that are still refusing to accept my token payment of £1.00 per month for the next six months, to be reviewed. Everone else has accepted, but im still getting harassing and intimidating phonecalls from Barclaycard, who are now threatening to add a 'DEFAULT NOTICE' to my account.

    Basically, is the fact that ive got this ongoing financial problem with them likely to affect my reclaiming the charges they have added???
    and what of the default notice??

    No, you can still reclaim the charges, there is a letter on here somewhere that you can send to tell them you only want to deal with them by mail. If they phone in the future i would advise them that you will only enter into conversation with them by mail and get that letter sent. Not sure on the default notice so will leave that to someone more qualified. But Don't worry and read as much as possible on here in the F.A.Q's

    Ref: Account Number:

    Despite my instruction regarding any communication from your company, which stated that I require all communications in writing, your telephone callsicon continue.

    This behaviour constitutes harassment; my instruction stated quite clearly to you that I require all communications in writing. Do not telephone me again and remove any telephone numbers you hold for me from your systems.

    Your telephone callsicon are in breach of the Office of Fair Trading guidelines. If you continue to telephone me after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office. For your information note that all telephone callsicon are recorded.

    This type of debt collectionicon method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distressicon to the recipient. Your methods will not be tolerated. Should the telephone calls not cease immediately a formal complaint, containing copies of all correspondence including yours, will be submitted to the relevant authorities. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

    Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

    I trust that I have made myself understood on this matter.
