I would just like to say that I live in Brighton and Hove which has probably one of the most avaricious parking regimes in the country - it nets the council £millions a year and is nothing more than a stealth tax, in my opinion. For this reason, I ALWAYS appeal every single pcnI have ever get and out of about 10 I have been successful every time!!!
Even if I'm not, I feel that if I do have to pay up, at least I've made the b*stards work for it! Anyway, this time I've been done for parking in a resident's permit outside where I live which was restricted due to a builders skip being in the adjacent bay. It was 5 pm on a Friday evening and all the builders had long gone. It was the only bay available within reasonable distance from where I live (even though I pay £80 per year for the privilege of parking in the street, they've seen fit to make the bays open to pay and display as well, so at certain times, I might as well spit in the wind as try to find a space).
Anyway, sure enough I got a PCN, and I appealed it and this time they're sticking to their guns. They've sent pictures which the warden took before issuing the ticket which show the car in the bay and the sign stating that the bay is restricted. However; the sign is behind a wire fence and partially obstructed by a scaffold tube. My question is, is there a legal requirement fo the sign to be 'clearly' displayed? Can I make representations to the council to say that because the sign was not clearly displayed, the PCN was illegally issued? Well I'm gonna do it anyway but if any of you legal seagulls out there have any advice to offer it will be gratefully received
