prelimary letter for £272 on 14th August 2006
they recieved it on the 15th August 2006
FOB letter sent to me 26th August 2006 lba letter for £296 (more charges added) on 29th August 2006
they recieved it on the 30th August 2006
Filed the N1 Claim form to my local court for £316.30 + 6p per day, (less one charge which was a cash handling fee oops) on 13th September 2006.
Also sent them a C.C.A (Consumer Credit Act) request for my credit agreement on 17th August 2006
they recieved it on the 18th August 2006
12 days have now expired on the 30th August 2006
1 calander month expires on 30th September 2006 when they will have broken the law. (bring it on )

hi all i got a notice that acknowledgement of service has been filed letter today
the defendant filed an acknowlegement of service on 27/9/06 the defendant has 28 days from the date of service is this from the 27th or the 23rd when it was deemed served
any advice would be appreciated

just read it properly now and can answer my own question it is from the 23/9/06 when the particulars of claim was deemed served
28 days plus 23/9/06 = 21/10/06 they are defending all of the claim
can anyone tell me what to excpect next

The CCA request letter i sent to them on the 17th August 2006 they would of failed to comply by the 5th October 2006, they have broken the law and failed to provide my credit agreement so i have a couple of questions
1/ should i wait until i have got my charges back and then send a non-compliance letter
2/ should i send them a non-compliance letter on the 5th October 2006
and also is there a template letter anywhere for non-compliance of a CCA request.
5th October date was reached by 18th August they received the letter 12 working days is the 5th September plus 1 calander month 5th October 2006.
any advice would be very helpfull

RECEIVED CHEQUE TODAY
hi all they have paid up what i was claiming for £316.30 but there are conditions set ie no telling anyone and they still owe 22 days @ 6p = £1.32.
what letter should i write back and should i ask for the £1.32
and also what sort of letter do you write to the courts to stop action
any advice would be greatfull

just write claim number and that you no longer wsh to pursue court action as you have been refunded, but for gods sake dont do it til the cheque clears and you have the cash in your hand! and dont agree to confidentiality, you already have cheque anyway! i wouldn't bother with the £1.32

the cheque has cleared and i have not accepted conditions so another victory to the people 12 more to go
i have also informed karnevil of my litigation concluded
now it is just my credit agreement to come by this monday or its a letter off saying they have broken the law and i must not owe them anything if they can not show it to me

CCA lba sent monday 16/10/06 stating they have until Monday 23/10/06 to send a true copy of the credit agreement or there is no debt with them and not to try and get any more money off me

When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.

thanks caro fantastic site here led me the way to about 10k i did not no i had i am going to do another donation on the receipt of my new cheques comming from HSBC.
When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. here is a strange one for you all to digest today ireceived a letter from RBS saying sorry for the delay of my credit agreement copy of which is not a signed copy so they have still broken the law and it say's they have looked into my corespondance and noted my first prelim letter for payment of £275 of charges which already been paid through the court stage and they have sent another cheque for the £275 when i had already been sent £350
dillema what would you do?????????

hi caro the first payment was for £330ish that was £275 for charges plus court interest and this one was for the charges of £275. I think that doing the two simultaniosly court procceedings with the charges and threatening to have them put into jail for not sending me my credit agreement they have got confused.
