Hi

I had an accident two days ago. It was my fault but the damage to the other car was minor so I suggested I could pay for it. Today the driver called me and said that he can have the car repaired for 150 pounds. It suits me, but is it legal and how can I protect myself against future claims ( medical claims ). Is there any form or a statement template I can use?

( Obviously it was a simple collision where speed of the both cars was very low and there is no way anybody could suffer any injuries ).

It is a condition of your car Insurance that you advise them of all accidents, even if you are not claiming from them at this time. But they will increase your premium from renewal.

 

You can settle directly with the 3rd party, but there is nothing legally (paperwork wise) that you can use to stop them claiming later for a PI. If in a years time they have a PI and they are able to link it to the accident, then they can still pursue you. This is why sometimes informing your Insurers can make sense, as if you don't they would be justified in not covering a PI that was later informed to them.

 

Only you can weigh up the situation to decide whether you go down the official route or not. It is your gamble.
