Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
If it is quite recent, just go into the branch (if you can) and challenge it. I have done this a few times in the past and they can refund as a "goodwill gesture".
Personally I dont care whether it is a goodwill gesture or a sincere change of heart after breaking down with the burden of guilt......I just want my dosh back!
I am joining the RBS forum for the very large sum of...........£38.00!!!!
I have only had one charge on this account but if its my money then I want it back!!
My pre-lim is going off today so wish me luck!!! Do u think I will just get this back cos its so small??
Clark xx
i am sure they will pay up straight away if you phone them stating that you are a member of CAG. and you know there charges are an unlawful penalty. A good trick is if they refuse ask them to provide you with a complete Breakdown of their charges, i got a refund straight away.
I dont fancy going in the branch because its really small and everyone will hear me!!
It was on the 1st of June and it was because I couldnt get into the bank the day before to put £35 in for a d/d. I went in on the day but it was too late!
They could of paid the d/d for less than the charge!!
I might try calling up later on today, thanks for the advise both of you.
It is very much appreciated.
Will let you know hoe I get on

hi i would use the fact that people will hear you to your advantage! Tell them their charges are unlawful under and quote the regs.... see what happens then.
I just think ill get all tongue tied and sound like an idiot!
Its so much easier doing the letter thing, saying that it does seem long winded for £38.00.
I'll ring, im too scared to go in!
Clark xx
ok just have the relevant info in front of you. dont be scared also a tactic i tried which worked was, if they refuse to give you the cash back tell them you require a full Breakdown of how they arrive at their figure for charges. try that.
Ok....Got the guts up to phone my branch and spoke to a rather nice chap! Anyway he said there was nothing he could do and would have to get a manager to call me back
We wait.......

Call from bank, as it is my only charge on the account I can have it back as a 'gesture of goodwill' but please note that it is in the terms and conditions and I must adhere to them!!'
Not bothered....five minutes, MY 38 quid back in MY pocket YIPPEEEE!!
