    Default blueberrys v. Barclays *WON*

    Just found my way to the site this weekend via Martin Lewis' money saver site. Can't believe I didn't know about this before but ready to do battle with the banks to get back what's rightfully ours. FAQs and members' postings have been incredibly helpful and motivating, so here goes.....!!

    Here's to success. But a "speedy response" - sorry, certainly not from Barclaysicon. Their only strategy for dealing with this problem seems to be to delay as much as possible at every stage, presumably in the hope that people will give up in frustration.

    Hi,
    I sent my prelim request to Barclaysicon 22.9.06 and received a reply from them dated 28.9.06 with a leaflet (why do they ignore what we say!!) and a promise to look into my concerns and reply by 20 October - or I can ring them to discuss on an 0845 number!! No way I'm doing that, but should I stick to my original deadline and send the lbaicon on 6.10.06?

    Hi there. Wonder if anyone can help on a legal technicality here. Barclaysicon have offered the full amount we are claiming in a letter received today 'in Full and finalicon settlement'. I know we have to settle as it is the amount we requested and we are delighted to do so. Just wondering if that wording means we cannot claim again for any unlawful charges applied after this.

    Would we be better typing up our own acceptance stating that we reserve this right or is it OK to proceed with the form we've been sent?

    If you've experienced this and know what to do your help would be much appreciated

    You should accept their offer of a "Full and finalicon settlement", as long as there are no strings attached, such as a confidentiality clause that they sometimes insist upon.

    If you are happy with the terms of their offer, then go ahead and sign.

    This does not prevent you from claiming for other charges in the future, or even in the past, that were not included in your original claim. All they are agreeing to settle is the amount you are claiming for, as per your charges schedule, together with your costs and interesticon.

    essjaysea is absolutely right.

    You would be agreeing to accept payment in "Full and finalicon settlement" of your specific claim. If they charge you again, (and they will 'cos, as we've always said, it's an automatic system!) you can claim again.

    Just double check before you accept that you are getting the full amount you claimed, including interesticon.

    Thanks guys. Have checked the letter and it looks 'clean' with regards to any confidentaility clauses or references to future charges. Will return the acceptance and keep you posted as to when the refund happens (no doubt they'll take their time!!)
