Hi guys, firstly may i say what an excellent forum. Just been reading through a few other threads and was amazed at the prompt help people have received.

 

Out of the blue i received a liability order that was granted in 2007 for council tax arrears for the previous year. I am guessing that they found my current address now that i have passed my driving test and have written to me.

 

During the 06 period they say i owe £1167 when i was actually a student doing a HND. At this time i was living in a student house but some of the other tenants were not students.

 

I can get a back dated exemption form from the college i was at but when i phoned the council office they said to send it with a letter explaining the situation and "touch wood" i would have the debt removed.

 

Im not quite sure what they meant by "touch wood" as it seems a clear cut case. A few things are bothering me is that they may want to know who else was living at the property and i dont want to drop anybodies name in the firing line. Im also a bit miffed as to why they had a court session without me knowing back in 2007.

 

Could someone tell me how to proceed with this and what information i should include in my letter?

properties that are only occupied by students are exempt from council tax

 

if the property is occupied by a mixture of students and non-students, there will normally be a charge

 

if all the occupants including yourself were of an equal status e.g. all tenants, then the student tenants are not liable for the charge, butthe non-student tenants will be

 

however if the occupants had different statuses, e,g, if you or one of the others owned the property and the others were (sub) tenants, then the owner would be the person liable for the charge

 

i would simply send them a letter explaining that you were a full time student, and therefore should not be held liable for any charge that may have been applicable and request confirmation that you will be immediately removed as a liable person

I am just letting you know that as you haven't had any replies to your post yet, it might be better if you post your message again in an appropriate sub-forum. You will get lots of help there.

 

Also take some time to read around the forum and get used to the layout. It is a big forum and takes a lot of getting used to.

 

 

Once you start to find your way, you will soon realise that it is fairly easy to get round and to get the help you need.
