2nd letter Data Protection Act req sent 15th Aug. 7th Sept recieved "As explained previously"letter. 09th September Req for Repayment sent £628 in charges + £152.90 interest = £780.90
missed something! 19th October, recieved offer of £166, which they paid straight onto account!
Next on the List Lloyds TSB - have to open another Bank account first!
I recieved the letter
"Putting the above aside, as a goodwill gesture and without any admission of liability, the difference between the charges you have incurred and the £12.00 fee recognised by the OFT, In accordance with the list of charges that you have set out, this would amount to £166. This adjustment will be confirmed on your next statement"
My next step??
Do I,
Just thank them for the payment, but inform them I intend to carry on with claim?
Not even acknowledge the part payment?
Complain that they have credied my card, and not my bank account?
Your help will be appreciated, also, anyone have any good links to a good template for my next step?

Amend the 1st paragraph of the lba along these lines.
Thank you for your letter dated xx/xx/xx and settlement offer of £ XXX
I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder.

I refer to your letter dated xxx
I note that you are dissatisfied with our offer to refund £166; however our position remains that we believe it is fair when customers break the terms of their agreement with us, we recover the costs. Therefore I am not prepared to consider your request for further refund.
As previously advised, when your Barclaycard account was opened you signed and agreed to our terms and conditions and this included details of our charges. The information provided at application stage clearly explains our obligations to our customers, as well as their obligations to us. If we make any changes to the terms and conditions we provide details of these to our customers.
I appreciate that this may not be the out come you expected, however I trust that the information I have provided has clarified Barclaycard's position.
Should you have any further questions regarding this matter please do not hesitate to contact me. If my reply does not meet with your expectations you may ultimately be eligible to refer to the Financial Ombudsmun Service. Further details of this service are available on request. If i have not hears from you within 8 weeks from the date of this letter, I will close my complaint file in accordance with our usual practice.

So, do I just roll over and leave it now, Or do I just go right ahead and MCOL?
PS: As Barclaycard have stated themselves, they did not bring in any charges until 2001, Can I use the argument that I never recieved notification of any charges that would be applied, these charges were not there when I opened the account. OOOOOO I am geting scared!

Read this, the Information Commissioner have told Barclaycrud they are in breach of DPA and to comply with SARs and are encouraging those microfished to persue Barclaycrud for damages.
