    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My son has recently completed his HND studies and has gone on to study at Sussex Uni as part of a continious process.

 

My local council (Crawley) has so far refused to allow the Students discount for the period between June - Sept (The summer recess) as they say he changed courses and was not therefore in continous full time education.

 

Looking at the "The Council Tax (Discount Disregards) Order 1992

3. A person is to be regarded as undertaking a full time course of education on a particular day if—

(a)on the day he is enrolled for the purpose of attending such a course with a prescribed educational establishment within Part I of Schedule 2 to this Order, and

(b)the day falls within the relevant period for that course."

 

It therefore appears that under the terms of the law Student discount is only available at a daily rate when attending the couse.

 

This can not possibly be correct, can any one give me direction as to why Students are not liable to council tax during the holiday periods and is it correct that my local council levy Tax as a result of the course title changing during a period of continious education.

 

Any advise much appreicated

Your missing out the further part of the regulation :

 

9. In this Schedule, the relevant period for a course or programme means the period beginning with the day on which a person begins that course or programme and ending with the day (“the last day”) on which he completes it, abandons it or is dismissed from it (which period includes any periods of vacation between terms and before the last day).

 

Any day on which you are registered on the qualifying course counts as a you being a student from start to finish irrespective of whether that day is a holiday or not (not all courses have the same holidays).

 

This can not possibly be correct, can any one give me direction as to why Students are not liable to council tax during the holiday periods and is it correct that my local council levy Tax as a result of the course title changing during a period of continuous education.

 

It sounds like the first course officially ended at the start of the holidays and he only started a new course from September. If he had any period where he was not registered on a full time course with the university then he is not a student for that day.

I guess my position is somewhat unique being a male single parent, working and supporting a Student.

Its truly amazing what we (my son and I) are not entitled to! (a bit of bitterness, sorry!)

 

However as far I as can gather, no else is subject to the payment of Taxes during the summer recess. As an example Uni Campus are except from Tax during this period.

 

I will let the complaints procedure deel with it and see where it leads.

What I can not understand from this poorly worded legislation is, that the Tax deduction is calculated at a "Daily Rate" if so, how is this applied?

 

Example 1

Council Tax £1000; days in uni (5dayx 25Week= 125days); Deduction =1000x(125/365). (Daily Rated)

Example 2

Council Tax £1000; weeks in uni = 25; Deduction= 1000x ((25*7)/365 (Weekly rated)

Example 3

Council tax £1000 registered each year £1000-25% (but of what period) Sep Year 1 - Jun Year 2 followed by Sep Year 2 - Jun Year 3 how is the tax then calculated.

 

Both arrive at different discounts for the same period, something is most deffinatly missing!

 

If it is just bassed on "registered" then it 365, surley there must be some simple explaination somewhere?

Did you get Child Benefit for him.... and are you still getting it?

 

If so, take the notice down the CT offices and they'll make the adjustment. I had a similar scenario with my daughter and was advised that the discount would stop.... so took the paperwork down there.

The basic calculation of council tax is the daily rate - annual charge / 365 (or 366).

 

If your son was a full time student for the entire year the your discount would simply be 25% of the full years charge.

 

As he has a break in studies then it would be calculated as follows:

(assume he was a student from 1 April 2010 as an example and the council tax annual charge is £365.00)

 

 

1 April 2010 - 31 Jun 2010 = 91 days . £91 * 0.75 = £68.25

1 July 2010 - 31 Aug 2010 = 62 days . £62 * 1.00 = £62.00

1 Sep 2010 - 31 Mar2011 = 212 days . £212 * 0.75 = £159.00

I never had a break in the 25% reduction for my daughter though. She left school after A-levels and went onto an Art foundation course at college the following September. When that finished a year later, she went to uni. in October (2010), so although there was a break between leaving college and going to uni., Child Benefit was still payable... which meant that the discount still applied.

 

Now that she's at uni. for the next 3 years, the 25% still applies... although obviously I no longer receive CB for her.
